DeepTechSol is a registered technology business in Pakistan and is registered with the Pakistan Software Export Board (PSEB).
These Terms and Conditions (“Terms”) govern access to and use of DeepTechSol websites, applications, software, platforms, products, services and associated product websites or brands (collectively, the “Services”).
By accessing or using a Service, creating an account, placing an order, purchasing a Service, or otherwise accepting these Terms electronically, you agree to be bound by them. If you do not agree, you should not use or purchase the Services.
1. Services and Scope
DeepTechSol offers standardized SaaS and digital services that may be purchased online, alongside customized business and enterprise technology solutions.
Where a separate written agreement applies to a customized business or enterprise engagement, that agreement will govern the relevant services.
Individual Services may have additional product descriptions, usage requirements, service limitations, pricing terms or other conditions displayed on the relevant website, pricing page, order page or checkout page. Those terms form part of your agreement for that particular Service.
DeepTechSol may introduce, modify or discontinue products and Services from time to time.
2. Accounts, Orders, Pricing and Prepaid Services
You must provide accurate and current information when creating an account, placing an order or completing any required verification.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You must promptly notify DeepTechSol if you become aware of unauthorized access or use.
Prices, service periods, trial terms, plan features and other commercial conditions are those displayed on the applicable product, pricing, order or checkout page at the time of purchase.
The price displayed as payable at checkout is the amount payable by the customer unless clearly stated otherwise.
Unless expressly stated otherwise for a particular Service, DeepTechSol Services are provided on a prepaid basis.
DeepTechSol’s online SaaS and digital services do not automatically renew. Access is provided for the period purchased. To continue using the Service after that period, the customer must purchase a further service period.
DeepTechSol may change future prices, plans or service offerings. Such changes will not retroactively alter the price of a prepaid service period already purchased.
3. Payments, Cancellations and Refunds
Payment must be made through a payment method accepted by DeepTechSol for the applicable Service.
DeepTechSol may verify payments, reject or hold suspicious transactions, and suspend or withhold provisioning where a payment fails, is reversed, remains unpaid, appears fraudulent, or requires further verification.
Because DeepTechSol provides digital products, software access, cloud resources and other services that may be provisioned or made available immediately, payments for activated or provisioned Services are generally non-refundable.
DeepTechSol may, however, approve a full or partial refund in exceptional circumstances, where reasonably appropriate, or where required by applicable law.
Any approved refund will normally be returned through the original payment method where reasonably possible.
Where DeepTechSol permanently discontinues a prepaid Service before the end of an already-paid service period, and the discontinuation is not caused by the customer's breach, misuse or unlawful activity, DeepTechSol will provide an appropriate pro-rata refund for the unused portion of that prepaid period.
Different refund or payment arrangements contained in a separate business or enterprise agreement will govern that engagement.
4. Acceptable Use and Right to Refuse Service
You may use the Services only for lawful purposes and in accordance with these Terms and any applicable product-specific conditions.
You must not:
- use a Service for unlawful, fraudulent, abusive or harmful activity;
- attempt unauthorized access to accounts, systems, servers or networks;
- interfere with, disrupt or compromise the security or operation of a Service;
- introduce malware or conduct attacks, spam, abusive automation or similar harmful activity;
- circumvent security, access, account, licensing or technical restrictions;
- reverse-engineer, decompile, copy or improperly reproduce proprietary software except where expressly permitted by applicable law;
- misuse Service resources in a manner that materially affects DeepTechSol, its infrastructure, other customers or third parties; or
- use a Service in violation of the lawful rights of another person.
DeepTechSol may refuse an order or refuse, restrict, suspend or terminate access to a Service where reasonably necessary because of non-payment, fraud or suspected fraud, abuse, security risk, violation of these Terms, unlawful activity, excessive or improper use, legal or regulatory requirements, third-party restrictions, or reasonable operational or commercial considerations.
Where reasonably practical, DeepTechSol may provide notice or an opportunity to remedy an issue before suspension or termination. Immediate action may be taken where necessary to protect users, DeepTechSol, infrastructure, third parties or the security and integrity of a Service.
5. Intellectual Property and Third-Party Services
Unless otherwise stated, DeepTechSol or its licensors own or lawfully use the software, systems, designs, interfaces, documentation, content, branding, trademarks, graphics and other intellectual property made available through the Services.
Purchasing or using a Service does not transfer ownership of DeepTechSol intellectual property. Customers receive only the limited right to use the applicable Service in accordance with these Terms and any applicable product conditions.
Services may rely upon or interact with third-party networks, hosting providers, cloud platforms, payment systems, telecommunications providers, APIs, software, websites or other technologies.
DeepTechSol does not control all such third-party services and cannot guarantee their continued availability, performance, compatibility or policies. Changes, failures or restrictions imposed by third parties may affect a Service.
6. Service Availability, Security and Changes
DeepTechSol will make reasonable efforts to operate and maintain its Services, but Services are provided on an “as available” basis to the extent permitted by law.
DeepTechSol does not guarantee that a Service will always be uninterrupted, completely error-free, available at all times, compatible with every device, website, application or third-party service, or achieve any particular performance, commercial or technical result.
Maintenance, upgrades, security work, technical faults, network conditions, infrastructure changes or other operational requirements may temporarily affect availability.
No internet-connected, cloud-based or electronic system can be guaranteed to be completely secure. DeepTechSol will take reasonable measures to protect its systems and Services, but cannot guarantee absolute protection against every cyberattack, unauthorized intrusion, vulnerability, malware incident, data-loss event or other security threat.
DeepTechSol may update, configure, migrate, replace, restrict, suspend, modify or discontinue all or part of a Service where reasonably necessary for operational, commercial, technical, security, legal, regulatory or third-party reasons.
Nothing in these Terms requires DeepTechSol to continue operating any particular product, technology, infrastructure provider, server, feature or Service indefinitely.
7. Force Majeure
DeepTechSol will not be responsible for a delay, interruption or failure to perform caused by circumstances beyond its reasonable control.
Such circumstances may include natural disasters, fire, flood, war, civil disturbance, acts of government, regulatory action, power failures, internet or telecommunications failures, cyberattacks, widespread security incidents, failures of hosting or cloud providers, banking or payment-network disruptions, labour disruptions, infrastructure failures, or other events that DeepTechSol could not reasonably prevent or control.
DeepTechSol may suspend, alter or discontinue affected Services where reasonably necessary because of such circumstances.
If an affected prepaid Service is permanently discontinued rather than temporarily interrupted, the unused portion of the prepaid period will be handled in accordance with Section 3.
8. Disclaimers, Indemnity and Limitation of Liability
To the maximum extent permitted by applicable law, DeepTechSol does not warrant or guarantee any particular business result, profit, income, productivity improvement, technical performance, availability, compatibility or other specific outcome from the use of a Service unless expressly agreed in writing.
To the maximum extent permitted by applicable law, DeepTechSol will not be liable for indirect, incidental, special, consequential or similar losses, including loss of profits, revenue, business opportunity, anticipated savings or business interruption arising from use of, inability to use, or interruption of a Service.
To the maximum extent permitted by applicable law, DeepTechSol's total aggregate liability arising from a particular Service or claim will not exceed the fees actually paid to DeepTechSol for the affected prepaid service period giving rise to that claim.
You agree, to the extent permitted by applicable law, to indemnify DeepTechSol against reasonable claims, losses or costs resulting directly from your unlawful use of a Service, fraud, intentional misuse, material breach of these Terms, or violation of the lawful rights of a third party.
Nothing in these Terms excludes or limits any liability, remedy or right that cannot lawfully be excluded or limited.
9. Termination, Changes and General Terms
You may stop using a Service at any time. Ending use of a prepaid Service does not automatically create a right to a refund unless otherwise stated in these Terms, the applicable product conditions, or required by law.
DeepTechSol may update these Terms when reasonably necessary to reflect changes to Services, business operations, legal or regulatory requirements or other legitimate reasons. The updated version will be made available through the relevant website or Service and will state its latest revision date.
Material changes may also be communicated through an account, Service, website, email or other reasonable means where appropriate.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Failure by DeepTechSol to enforce a provision on one occasion does not waive its right to enforce that provision later.
DeepTechSol's handling of personal information is governed separately by its Privacy Policy.
10. Governing Law, Jurisdiction and Contact
These Terms and any dispute arising from or relating to them or the Services will be governed by the laws of Pakistan.
Subject to any jurisdiction or remedy that cannot lawfully be excluded, the competent courts at Lahore, Pakistan shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.
Before commencing formal proceedings, the parties are encouraged to make reasonable efforts to resolve a dispute through direct communication.
